Our Terms and Conditions:

  1. Goods once sold or services rendered will not be taken back or exchanged unless otherwise agreed in writing.
  2. Payment shall be made as per the agreed terms mentioned on this invoice. Delayed payments may attract interest at 18% per annum (or the maximum rate permitted by applicable law) from the due date until full payment.
  3. Title to the goods shall remain with Shailesh Computers and Tutors until full payment of this invoice has been received.
  4. Any warranty on products supplied is limited to the manufacturer’s warranty, wherever applicable. Shailesh Computers and Tutors does not provide any separate warranty unless specifically stated in writing.
  5. Warranty does not cover physical damage, liquid damage, electrical surges, misuse, unauthorized repairs, normal wear and tear, software issues, virus or malware infection, or damage caused by natural calamities.
  6. The customer is solely responsible for maintaining backups of all data. Shailesh Computers and Tutors shall not be liable for any loss of data, software corruption, business interruption, or consequential damages arising during or after installation, repair, servicing, or replacement.
  7. Software installation, operating system installation, data recovery, virus removal, and configuration services do not guarantee recovery of lost data or future protection against software or hardware failures.
  8. Delivery dates, installation schedules, and repair timelines are estimates only and may vary due to availability of products, spare parts, logistics, or circumstances beyond our reasonable control.
  9. Risk in the goods shall pass to the customer upon delivery. The customer shall inspect the goods immediately upon receipt and notify any shortage, transit damage, or defects within 48 hours of delivery. Claims made after this period may not be accepted.
  10. Installation or service shall be deemed accepted upon completion and customer acknowledgment through signature, email, WhatsApp confirmation, or digital service report.
  11. Replacement parts used during repairs may be new, refurbished, or OEM equivalent depending upon availability, unless otherwise agreed in writing.
  12. The customer shall ensure that only properly licensed software is installed on their systems. Shailesh Computers and Tutors shall not install or support pirated, counterfeit, or illegal software.
  13. Any additional work or services requested outside the scope of this invoice shall be charged separately at the prevailing rates.
  14. Shailesh Computers and Tutors shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of business, loss of goodwill, or loss of data. The maximum liability, if any, shall not exceed the amount actually paid under this invoice.
  15. Any dispute arising out of this invoice shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
  16. Electrical products should be used only with a proper earthing and suitable voltage protection. Damage due to power fluctuations, improper installation, or electrical faults is not covered under warranty.
  17. Repair charges are for the work carried out and do not constitute a guarantee that the equipment will remain free from future faults. Additional faults arising after service shall be treated as separate service requests unless covered under an active AMC or warranty.
  18. AMC services are governed by the separate AMC Agreement executed between the parties. In case of any conflict, the AMC Agreement shall prevail.
